Terms and Conditions

1. Introduction

Welcome to Ebuymore ("we," "our," or "us"). By accessing or using our web application, you agree to be bound by these Terms and Conditions. Ebuymore is a digital marketplace connecting local vendors ("Mama Mboga," "Butcheries," etc.) with buyers in their vicinity.

2. The Ebuymore Platform

Ebuymore acts strictly as a facilitator. We provide the technology for Vendors to list goods/services and for Buyers to order them. We do not own, sell, or take possession of the goods listed (unless explicitly stated).

Contracts for the sale of goods or services are directly between the Vendor and the Buyer. Ebuymore is not a party to that transaction and assumes no liability for the quality, safety, or legality of the items sold.

3. User Accounts

• Eligibility: You must be at least 18 years old to create a Vendor or Rider account.
• Accuracy: You agree to provide accurate phone numbers and location data to facilitate deliveries.
• Security: You are responsible for maintaining the confidentiality of your account credentials.

4. Vendor Obligations

Vendors must ensure that:

• All product listings (vegetables, cereals, services) are accurate and available.
• No illegal, expired, or hazardous goods are listed.
• Prices listed include all applicable taxes unless stated otherwise.
• They fulfill orders promptly upon acceptance.

5. Orders, Pricing, and Payments

• Pricing: Prices are set by the individual Vendor.
• Payments: Payment methods include Cash on Delivery (COD) and M-Pesa. By selecting M-Pesa, you agree to pay the Vendor directly via their provided Till/Number.
• Delivery Fees: Delivery fees are set by the Vendor based on the local 5km radius logic.
• Cancellations: Buyers may cancel an order only if it has not yet been dispatched. Vendors reserve the right to cancel orders due to stock unavailability.

6. Delivery Policy

Deliveries are handled by independent Riders or the Vendors themselves. Ebuymore does not employ riders directly. Delivery times are estimates and depend on local conditions in your area (e.g., Utawala, Kayole).

7. Prohibited Conduct

Users may not:

• Use the platform for fraud or scamming.
• Harass other users or use abusive language.
• Post false or misleading reviews.

Violation: We reserve the right to suspend or ban any user violating these terms immediately.

8. Limitation of Liability

To the fullest extent permitted by Kenyan law, Ebuymore shall not be liable for any indirect, incidental, or consequential damages arising from the use of our service, including but not limited to damages for loss of profits, goodwill, or data.
